Police: Boise man living at local day care busted for pot

Police: Boise man living at local day care busted for pot
BOISE - Police say a 22-year-old Boise man has been arrested after they say he was found with marijuana inside a local daycare.

Officials say they received a call at 11:15 a.m. today from an anonymous citizen who reported a strong odor of marijuana coming from a 24-hour in-home day care at 1906 Bedford Street on the Boise Bench.

"As soon as officers arrived they too smelled the overwhelming smell of marijuana coming out of this day care," Police spokeswoman Lynn Hightower said.

Police say they found seven children and two day care workers inside the home, along with a resident of the home, Kenyon York-Byers.

Officers say they found York-Byers with two and a half ounces of marijuana packaged in baggies, and evidence that the suspect had the intention of selling the marijuana.

"There's evidence he was selling marijuana and sharing a home with a day care is a very very dangerous situation," she said.

The owner of the day care, also a resident of the home, was not home at the time and is a relative of the suspect. Boise PD says York-Byers is not a worker at the day care but shared the home with the business - living there for only about the last two months.

Police say according to the Boise City Clerk's office, the day care in the home is licensed by the City of Boise and has been since 2005. Wednesday evening the city did revoke their child care license .

"The drugs found in that home with seven very young babies and toddlers inside that home was alarming to officers and that day care is shut down."

The owner of the day care was not identified and when KBOI-TV 2News went to the door, a woman answered and would only say this whole ordeal is a big misunderstanding.

York-Byers has been charged with felony delivery drug charges and seven misdemeanor child endangerment charges (one for each child).

Police are still investigating whether York-Buyers' clients came into the home to buy the drugs and home much contact he had with the children.
