Brother charged with neglecting mother sentenced

CALDWELL - A Canyon County man has been sentenced in court after authorities say he and his brother let their aging mother live in filth.

John Bujak, Canyon County prosecutor, said David Nicks was sentenced to five years, but Nicks could avoid going to prison. Instead, a judge suspended the prison sentence and is ordering Nicks to serve three years on probation.

Nampa Police found their mother surrounded by feces, flies and cans of dog food last fall. Earlier this month, David's brother, Danny, pleaded guilty to neglecting his mother. Danny will be sentenced in August.

Because Nicks is appealing the sentence, the probation period won't begin until an appellate court issues its ruling.
