Gymnastics teacher who had sex with teens gets 15 years

BOISE, Idaho (KBOI) - A local gymnastics instructor who had sex with two teen girls has been sentenced.
According to court records, Derek Q. Nesbitt, 22, was sentenced Friday to 15 years in prison. He'll have to serve five years behind bars before he's eligible for parole.
Officials say they began investigating Nesbitt after receiving reports that he allegedly gave alcohol to minors at his home on the 2200 Block of North Bluewater Place.
The investigation revealed the gymnastics instructor had sexual contact with at least two females between the ages of 16 and 17, deputies say.
Detectives say Nesbitt met the teenagers while assisting the Borah High School cheerleading squad and through his work as an instructor and coach at a Meridian gymnastics facility.
A judge also ordered him to pay more than $26,000 in fines.

So you think spending ANY time in prison, and having to register as a sex offender doesnât destroy someoneâs life? I agree that there should be a punishment, however taking it to the extreme every time that the subject of sex comes up, is not necessary and is leading our state the way that Kern county California went in the 80âs.Look at the rest of the country, 39 states have laws that would reduce this punishment to a misdemeanor, or understand the fact that 22 and 17 just are not that far apart, especially considering that even our own presidentâs father was 26 and his mother was 17 when they had SEX to create Obama.Our punishment system is extremely flawed in these matters, to compare some other cases look at the violent crimes committed by 17 year olds, and then we put them in prison right alongside a person who we claim is a criminal for having sex with a 17 year old. Also look at the sentencing for a person that involuntarily ends someoneâs life, like the guy who ran over the motorcyclist and only got ONE year vs. the 25 that this crime comes with.I agree there should be a punishment, but you cannot tell me that is should be as severe as what this debacle turned out to be.
Just another case to show how back woods and ignorant the Idaho judicial system is.This case claims that a 16 and 17 year old is still a child, when in fact it has been scientifically proven that the human brain is developed enough at that age that they are capable of cognizant thought, thus to claim that they are these innocent and mindless little victims is wrong, especially when you destroy someoneâs life over this.I donât condone sex with minors, but to completely destroy someoneâs life over it, and grant a felony for it, when the rest of the country wouldnât even consider this a misdemeanor, is nothing short of draconian.
@Ronin Nobody said these girls were "innocent and mindless victims" or incapable of "cognizant thought," when in fact Idaho Law was changed in 2011 to state that a minor child 16 or 17 years old could have consensual sex with a partner within 3 years of their age. This statute takes care of the 18 year old "adult" boyfriend having consensual sex with his 17 year old "minor" girlfriend and then mom and dad of girlfriend wanting boyfriend charged with rape...which under the old law is what it was. Â
The fact of the matter is, this 22 year old individual was convicted of providing alcohol to a 16 and 17 year old minor and then having sexual contact with them... I'm guessing he was charged and convicted with sexual battery of a minor child 16 or 17 years old which carries a maximum of 25 years in prison under these circumstances. 5 years fixed with the possibility of parole after that hardly seems like "destroying" somebody's life but more of a statement that if you are willing to troll the gymnastics studio or high schools for underage drinking and sex partners you better be willing to pay the piper if you are caught....
