Parents of woman killed on Christmas Day file suit

COEUR D'ALENE, Idaho (AP) — The parents of an 18-year-old St. Maries woman who was shot to death on Christmas are suing the parents of the man charged in her death.

Twenty-eight-year-old Joseph D. Herrera is charged with second-degree murder in 1st District Court for the death of Stefanie A. Comack. Herrera, who was living with his parents, told investigators he was trying to unload the gun at his home when it went off, the bullet striking Comack in the head.

The Coeur d'Alene Press reports reports that Comack's parents, James and Suzane Comack, claim that Herrera's parents were negligent because they knew their son was likely to be violent to Stefanie Comack and they failed to ensure their handgun was locked.

Jerrilynn and Jesse Herrera have not yet filed a response to the lawsuit.
