Idaho man gets at least 90 days for walker's death

IDAHO FALLS, Idaho (AP) - An eastern Idaho man who pleaded guilty to hitting and killing a pedestrian will serve at least 90 days in prison under a retained jurisdiction program.

The Post Register reports 7th District Judge Jon Shindurling sentenced 49-year-old Nicky Lynn Bateman to three to 15 years in prison for vehicular manslaughter. But the judge also retained jurisdiction and said Bateman may be allowed to serve all but 90 days of his sentence on probation if he successfully completes a prison treatment and education program.

Prosecutors said Bateman was driving in Idaho Falls when he hit 53-year-old Martin Rodriguez, who was crossing the street. Prosecutors said Bateman fled the accident, and another motorist discovered Rodriguez, who died at the scene. Bateman was arrested in March after he turned himself in.
